Micron's planned manufacturing complex in Clay, New York, which includes four separate chip factories, is once again at the center of an environmental legal battle. The groups Neighbors for a Better Micron and Jobs to Move America, which had already filed a lawsuit against Micron in January, submitted a new complaint on Friday. The lawsuit challenges the validity of the wastewater and air permits issued by the New York State Department of Environmental Conservation, arguing that they would allow the release of per- and polyfluoroalkyl substances, known as PFAS or 'forever chemicals', into the Oneida River.
Allegations Against the Permits and the Environmental Review Process
The legal filing states that the permits were issued despite the significant environmental consequences already recognized during the review process under the State Environmental Quality Review Act. The plaintiffs argue that the Department failed to fully evaluate these impacts and did not impose the necessary protections before granting final authorization, instead deferring essential analyses, controls, and mitigation decisions to after the permits were issued. According to the petitioners, the permits are not routine operating approvals, and the loose guidelines are not merely collateral or technical omissions.
