The UK's energy regulator Ofgem has unveiled a bold proposal to clean up the grid connection queue, which is clogged with speculative data center projects that may never materialize. The plan, announced in July and set to be finalized after a feedback process ending in September, would require developers to pay a substantial non-refundable deposit, potentially reaching hundreds of millions of dollars for the largest facilities. They would also need to secure customers in advance and prove they have the funding to complete construction. But Ofgem faces a Goldilocks conundrum, the reforms must be tough enough to deter speculators, yet not so onerous that they drive legitimate projects to other countries, undermining the UK's AI ambitions.
The queue to join the UK grid ballooned in late 2024, around the time the government designated data centers as critical national infrastructure. Between November 2024 and June 2025, the total energy demand of projects in the connection queue skyrocketed from 41 gigawatts to 125 gigawatts, according to Ofgem. New data centers account for 73 gigawatts of that, equivalent to one and a half times the UK's peak electricity demand last year. However, many experts believe much of this demand is a mirage. Taco Engelaar, managing director at grid optimization firm Neara, calls it 'absolutely insane', adding that no one truly understands what the real grid demand will be because of these phantom projects.

The perverse incentives and the cost of waiting
Why so many phantom projects? The answer lies in an incentive problem. With years-long waits for grid access and historically low application fees of a few thousand dollars, developers have little to lose by applying for power, even without a solid plan. It is a no-downside bet that hedges against a future of sky-high compute demand. However, grid operators must account for the combined impact of all proposals on network stability before approving individual connections. As Olivier Darmouni, associate professor of finance at HEC Paris, explains, 'The more speculative projects are especially damaging because they make these studies more complex, more expensive, longer.' This congestion also attracts middlemen who apply for power intending to flip land at a premium, a practice Darmouni likens to concert ticket scalping. 'The congestion feeds on itself and gets out of hand,' he says.

Ofgem's latest proposal builds on existing rules that since 2024 require developers to demonstrate they have secured land rights, submitted planning applications, and met other milestones. The new measures add a hefty financial deterrent. According to Alex Burgoyne, head of data centers at Knight Frank, this is expected to 'pour water on a lot of speculative data center applications'. Yet, there are concerns about unintended consequences.

Risk of deterring investors and stifling industry growth
The steep fees could make the UK one of the most expensive places to build a data center, given its already high energy costs and limited land. Daniel Newton, a partner at law firm Slaughter and May, highlights the 'difficult balancing act', if the fee is too low, speculation continues, if too high, viable projects may be killed. The reforms might also favor only the largest companies, squeezing out smaller AI-focused operators like Nscale, which has pledged billions in UK investment. Burgoyne warns of 'unintended consequences' that could 'stifle growth in the sector'.

Despite these risks, some experts see the cleanup as essential for long-term strategy. Darmouni argues the goal is to 'build the data centers in the right place, at the right size, with the right power supply', but cautions that it is not a 'gas pedal' that will accelerate immediately. Ofgem, in a statement, recognizes data centers as 'a key part of the UK's AI ambitions' and asserts that enabling viable ones to connect faster is an enabler of this. The challenge is immense, and the world watches closely as the UK navigates between attracting investment and avoiding grid overload. Only time will tell if this cure proves effective or, as many fear, kills the golden goose. The game is on, and Ofgem's next moves will be decisive for the future of the country's data center industry.
