The US Department of Justice has announced that federal employees can now download and install TikTok on government-issued electronics, effectively ending a ban imposed in 2022 over national security concerns. The reversal follows the creation of the TikTok US Data Security Joint Venture, a new entity majority-owned by American investors including Oracle, with ByteDance retaining less than a 20 percent stake.

Justice Department cites independence from ByteDance as key factor

In its official statement, the DOJ said that the current version of TikTok operated by the joint venture "does not fall within this prohibition because the Joint Venture functions independently of ByteDance, is majority-owned by American investors, and has revised the content recommendation algorithm and cybersecurity program originally developed by ByteDance to insulate federal government information against the concerning security features that initially motivated the prohibition." This certification allows the app to be used on millions of government devices across federal agencies.

Algorithm and data storage now managed within the United States

When the deal was announced in January, TikTok promised that the new venture would protect American users' data using Oracle's secure US cloud environment. The US entity now trains the app's algorithm exclusively on data from domestic users, while still providing access to international content. This structural change addresses the core concerns that led to the original ban under the Trump and Biden administrations.

Individual agencies retain discretion to limit TikTok usage

Despite the nationwide lift, the Justice Department clarified that each federal agency independently decides whether to allow TikTok on its devices. "For instance, agencies may independently decide to ban the downloading of TikTok to government devices for workforce management reasons, such as promoting employee productivity," the DOJ wrote. This means some departments may continue to block the app even after the federal ban is removed.
